There is some important facts you should know about the credit bureaus and how they respond to credit disputes. Lately they have included notices when they follow up and respond with their results of the credit dispute investigations. One credit bureau in particular, Experian, notifies consumers with a rather stern warning that insinuates that it may be illegal to dispute certain items that you feel may be inaccurate. Their language also indicates that if you hire the services of a Credit Repair Organization, that you may be breaking the law and that you risk having the "authorities" get involved if you do so.

I can tell you in so many words that this is false. First, Experian refuses to let consumers purchase their FICO scores. Now they don't want to investigate inaccuracies on your credit report. The reason? People buy scores, not credit reports. They want to discourage consumers from seeing their scores simply because by knowing your score, you would probably be more inclined to initiate a credit dispute. That's their first strategy to stop your disputes. The letter is their second strategy. Its a shameful scare tactic they hope will keep you from disputing again.

You have the right under federal law to dispute ANY item you feel is inaccurate, misleading, or incomplete according to the Fair Credit Reporting Act. Not only that, but it is perfectly LEGAL to hire a 3rd party, credit repair service to dispute on your behalf. The Credit Repair Organizations Act was implemented to protect you from scams. If credit repair was illegal, why would the government create an Act to dictate the rules a credit repair service must adhere to? They would'nt if it was illegal.

I think the best course of action is to learn all you can with the huge amount of information available online about how to repair your credit on your own, instead of hiring a credit repair company. Credit repair companies are very expensive. There is a lot of resources, books, kits, etc available to show you how to do it on your own. Arm yourself with this information and take control of your credit today!

Get Your Credit Scores

Don't think that you only need to get your credit scores once, and all will be fine. You need to get your credit scores on a regular basis- Several times throughout the year. Be sure to check your full report as well, including any new items or negative entries that may pop up. If you notice anything odd or anything you don't recognize (such as a charge account you did not open) report it immediately. It very well could be someone attempting to steal your identity, or even a mistake made in reporting by the credit bureaus. Either way, identity theft or reporting mistakes both can take a toll on your credit score. Repairing your credit and credit errors improves your credit score. If you think you have been the victim of identity theft, take action at once:

1) Contact all three credit bureaus and ask to speak to the fraud department. Explain that you have been the victim of identity theft (or believe you may have been) and ask that an "alert" be placed on your file. This will let anyone looking at your report know that you may have been the victim of fraud. It will also mean that you will be alerted any time a lender asks to look at your file - each time a lender does look at your file, it may be an indication that the identity thieves are trying to open a new account in your name.

In some states, you can even ask for a freeze to be placed on your credit score and credit report which will prevent anyone but yourself and those creditors you already have from accessing your file. Any lenders the thieves contact to set up a new account will be refused access and the thieves will not be able to get any more money in your name. You are entitled to a free copy of your credit report if you have been the victim of identity theft. Be sure to take advantage of this offer so that you can check exactly how your credit has been affected. I've included a free resource at the end of this article where you can get your free credit report and your credit scores.

You should also call the Social Security Fraud Department. I had never heard of doing that until advised by a bank that called to tell me an application for credit was made over the internet in my name. The alert means any company that checks your credit knows your information was stolen, and they have to contact you by phone to authorize new credit.

2)Immediately file a police report. Identity theft is a crime and you need to file a police report (be sure to keep a copy of this report) so that you can help the police potentially catch the criminals responsible. Contacting the police will also give you a paper trail and proof that a crime has been committed. Keeping a paper trail of the crime and your response will make it easier for you to repair your credit if it has been damaged by identity thieves.

3)Call the Federal Trade Commission (FTC) at 1-877-438-4338. This is the special hotline that the FTC has set up to help customers deal with fraud and identity theft. You will be able to get up-to-date information about your rights and advice as to what you can do to improve your credit score and keep in safe in the future.

4) Make sure to alert all of your creditors that you think someone has applied to with your identity.. Ask to speak to the security department and explain your situation. You may need to have your accounts closed or at least your passwords changed to protect yourself. You may also need to fill out a fraud affidavit to state that a crime has been committed - be sure to keep a copy of this form for your records.

An important security step: Take all the contents of your wallet out and photocopy the front and back of each credit card, your license, and any other membership cards etc. believe me, you will be glad you did this if and when your wallet goes missing. The back of each credit card has the important 800 numbers you need when calling to cancel each card. You will be glad these numbers are handy. Keep a copy of this information filed away in a safe place or even a fire proof safe if you have one. I keep my copies of my wallet contents together with my original birth certificate, social security card, and other sensitive documents in a small fire proof safe.

Today I have an unheard of, little-known dispute strategy that can work in situations where the credit bureaus have determined that the prior dispute was"verified as belonging to you".  This is also good to use as a specific strategy and unique approach because it goes well beyond the general reasons for disputing such as "not mine", or "I was never late", etc. In fact, even if the credit bureaus rejected your "not mine" dispute, and concluded that the item in question was verified as belonging to you, there is no reason that you cannot dispute the item again.
Only this time around, you are going to get very specific and force the credit bureaus to actually do some work and investigate. (typically they use codes and rarely do they do anything that even remotely resembles investigating).
So instead of sending a general dispute letter claiming that the item isn't yours or that you have no knowledge of the account, you will attack specific listings and figures reported in the account.  Here are some examples of what I mean:
The item is being reported as an "open" account. This is not accurate, please delete this.
The item has never been 90 days late, please remove it.
The account is being listed as an "installment account". This false, please remove it.
This account is showing an inaccurate balance. Please correct the balance amount, or remove it.
The end of the 7 year reporting period should be listed as 6/2010. Please correct or remove this.

I think you get the idea.  Be specific with inaccuracies with the tradeline. Many tradelines are incomplete as well as inaccurate.  When you force the credit bureaus to actually look into the account, they have to put in work, which they usually try to avoid.  You are also avoiding being catagorized or considered in the group of "Not mine" disputes, so they are doing more than checking whether the creditor confirms it belongs to you or not.  And keep in mind, at no point did you claim the listing doesn't belong to you...you want to hold the creditor and the credit bureaus to the law under the FCRA.  And that means if they cannot prove that the listing is complete and/or accurate, it MUST be removed from your credit report.  Give this powerful method a try.  You will find it is very effective. You can find little-known methods like this and many, many other rare techniques that most people have no clue even exist----> RightHere

There is definitely no shortage of online credit repair ebooks and credit score-building products available online, but it sure can be a challenging task to find credit repair programs that are up to date with the latest techniques that really work to improve bad credit and increase your fico score.

So when I came across this product to fix your credit, I wasn't really expecting anything groundbreaking as far as unique and effective credit repair tactics. As a 12 year veteran in the mortgage and credit business, I have seen just about every "repair your credit" product in the market, and I'm very familiar with most every credit repair company.

---> In fact, most of the credit repair companies in existence are nothing more than "dispute letter mills" that leave the majority of their customers unsatisfied and often in worse shape than they were before they hired the credit repair company.

Many of the do-it-yourself (DIY) products are outdated and/or rehashed or basic material that most consumers can obtain free by spending some time online reading credit repair forums. With the constant changes in credit laws and the changes within the credit bureaus, what may have worked years ago may not necessarily work today.

---> So the question was: does this comprehensive program offer up to date quality information that you can put to use on your own to improve your credit fast without hiring a credit repair company???

One thing I know for certain, is that the credit bureaus are very keen on detecting whether or not a consumer is using the services of a third party credit repair company. And in case nobody told you, the credit bureaus seriously frown on consumers hiring and using a credit repair company to do their work for them. As a sidebar: Please don't hire a credit repair company. You seriously risk having the credit bureaus flag your disputes as "frivolous".

That is one of the nice features of this unique program, it not only shows you how you DO NOT need to hire a credit repair company, it goes on further to show you exactly how to approach the credit bureaus effectively, on your own, to insure you of the quickest and most effective deletions and credit clean-up techniques that the author, Chris Brisson learned as a long time credit repair expert.

"Is this simply a good sales pitch?" I was very pleased to discover that it isn't just hype. There are several gold nuggets of inside credit repair information and little known stealth, underground guerilla credit repair tactics that he divulges from his many years of experience as a manager at a major credit bureau.

37daystocleancredit offers techniques that I have not seen in any other credit repair guide. And I've seen a lot of credit repair guides. He offers insights on specifically what the bureaus look for, how they "flag" credit dispute letters, and the absolute best and ONLY way a consumer should approach the credit bureaus, and very detailed instructions on how to construct the ideal credit dispute letter.

Sample Letters Download

One of the nice features of 37daystocleancredit is the section on exposing the credit repair attorneys and the credit repair companies. in it, you discover exactly why you can actually damage your credit further by utilizing the services of an attorney or a credit repair company. often times a company may have success at temporarily deleting bad credit, but where they fall short, and where 37daystocleancredit shines, is insuring that all bad credit deletions become permanent deletions!Delete negatives from your report today!

I guess the only downside I saw with 37daystocleancredit was the section (bonus) on creating a brand new credit file. Fortunately, I did not need to make use of this technique because the tips, tactics and inside information this program provides was more than enough to increase my fico score over 135 points.

I saw this bonus of creating a new credit file a downside simply because I don't know how long that process would take, and some have questioned the legality of it. I'm not a lawyer, so I cannot speak to the legality of it. Some may question if it's ethical, and some may see it as another credit repair technique in the 37daystocleancredit arsenal of underground guerilla credit repair tactics.

Just when I thought I had heard all there is to know about credit building techniques, they offered up yet another stealth method of adding rental payment histoy to your credit report. That's right, he details how you can go about adding your rent to your credit report to increase your fico score.

Lastly, whenever considering an online purchase of any kind, always take into account the availability of the company, and the owner/author of the product. Does the website offer a physical address or at least an email address? Are they making themselves available to product questions and customer support? Or, are they hiding behind a PO box?

I can say in NO uncertain terms, this excellent program provides outstanding customer support, and I was pleased to get an answer to an emailed question within a day or two. I can list several other companies that offer credit repair guides that I purchased over the years that left me on my own and pretty much ignored my emails. Combine that with mediocre at best information, and needless to say I wasn't a happy camper. I'm just glad that I eventually found 37daystocleancredit. It's one of the few credit repair guides that I felt comfortable spending money on.

In conclusion, when you combine insider knowledge of credit law, with all of the quality little-known credit repair tactics, together with the most comprehensive quality bonuses not found elsewhere, in addition to a 2 month money back guarantee, it's easy to see why this is truly a "no-brainer" top of the line credit repair product. I give 37daystocleancredit my highest recommendation. Boost Your Credit Score 135 in 37 Days!

Several questions were asked about how a creditor might respond to this lawsuit of slander of credit. I can say for a fact that a small percentage of the creditor's attorneys have challenged the lawsuit, but the majority have either failed to respond or were willing to work out a settlement. And by settlement, I mean they have agreed to instruct their client (creditor) to delete all derogatory information in return for me to stipulate to dismiss the case.

However, I want to elaborate on what one particular creditor tried to do (unsuccessfully) inorder to fight the case. They had requested a motion for summary disposition claiming that I had "failed to indicate the common law or statutory basis upon which I was relying". He argued: "Plaintiff has failed to state a claim upon which relief can be granted, and Defendant is entitled to a summary disposition". And, "Plaintiff has no private right of action under the FCRA"

Here is an brief explanation of a request for summary disposition as it applied to my case and basically what the Defendant was claiming.

MCR 2.116(C)(10) permits the court to grant a motion for summary disposition where there is no genuine issue as to any material fact and the defendant is entitled to judgment as a matter of law. The party opposing the summary disposition has the burden of showing that a genuine issue of disputed facts exist. TopevsHowe 176 MICH App 91 (1989). The party opposing the motion may not rest on mere allegations or denials in the pleadings, but must, by affidavits or as otherwise provided by court rules, set forth specific facts showing that there is a genuine issue for trial. Dept of Social Services v Aetna Cas. & Sur. Co., 177 Mich App 440 (1989). Where the opposing party fails to produce documentary evidence establishing a material issue of fact, summary disposition is properly granted. Stanton v dachille, 186 Mich App 247 (1990)

Well, the problem the attorney had by citing this law for summary disposition is that I was able to produce documentary evidence by way of restricted certified mail (papertrail) of all of my disputes, mailings, credit bureau disputes, cancelled checks proving payments, copies of my credit reports showing inaccurate entries, etc. This was enough for the judge to deny the motion for summary disposition.

Next, after failing the summary disposition route, plan B was for the attorney to claim that I failed to show that the furnisher of information (creditor/Defendant) received notice from a consumer reporting agency, as opposed to the Plaintiff alone, that the credit information is disputed. Young v Equifax Credit Info. Services., Inc 294 F.3d 631 (5th Cir.2002) Here, they were claiming that I made no allegation that I had even disputed the matter with any of the credit bureaus! And again, I was able to show a solid papertrail of all of my disputes.

So, it is vital to insure that before you bring a case against a creditor for slander, defamation, etc., that you exhaust all other options required under the law. This obviously means disputing with the bureaus and disputing or requesting verification with the creditors. Fortunately, I discovered an excellent resource that will guide you step-by-step if you really want to EASILY and successfully bring a lawsuit against a creditor.
